Hi,
Any help here would be greatly appreciated. Apologies if this seems long winded, I received a parking ticket for restricted area, I appealed the ticket and lost and ticketi was referred to Jacobs.
I contacted Jacobs and explained I had lost appeal and needed to pay, however I had just been made redundant and was forced to claim universal credit. I asked to pay minimum amounts until back in work as I had zero income due to appealing universal credit system. The agreement was set up by Jacobs at £20 pmth, the next day Jacobs called and cancelled the agreement saying they shouldn't have entered into it as I had proven I had zero income therefore not proven what I had coming in?? They then insisted I pay £60 per month despite me proving I had zero income?!!
I contacted the council and advised them of their flawed policy were in zero income does not show proof of income??
The council accepted and informed Jacobs I had made a complaint about them. They also said themselves and Jacobs would let me know when the payment plan I had asked for £20 pmth on zero income( which I think is more than reasonable) had been set up.
This did not happen, the next I heard was Jacobs calling me informing me I had missed a payment or two and they demanded all monies. I explained I still had no job or benefits and my family were in a volnerable position, I was told none of this matters and baliff would be out of I didn't pay.
Obviously I couldn't pay the extortionate£185 but I immediately borrowed £40 and paid online to catch up that month and the previous, I heard nothing, I paid the next month early.
A baliff then called at my home while I was out and informed my partner, who I had already told them has mental health issues i.e.anxiety, depression, that when they returned it would be to remove goods. To stop my partner panicking I immediately borrowed further money and settled the debt. I did not pay the £235 Jacobs charge as this was all down to them breaking our agreement to start with and they had continued to keep my payments therefore I'm my eyes excepting payments.
I am now being harassed and persued by Jacobs who have not followed codes of conduct i.e. bullying a volnerable family with no income and continue to do so. I am now back in work but I am appalled by the actions and attitude of Jacobs and the council who ignore my complaints and in my eyes condone Jacobs actions.
I am now being too by Jacobs that I owe the council a further £235 which I don't this is Jacobs charges for visit and that they will visit to collect this and I will be charged s further £235 which I am sure is also illegal.
If anyone has any knowledge of the law or how to proceed I would greatly appreciate it. The behaviour of these people when someone is clearly a working man who has simply fallen on hard times is disgusting.

If you paid money online to a bailiffs website, then in all probability that money is a lost cause.

Jacobs is not even a company and official records show neither its trading name or the individual behind it is registered under the Data Protection Act to be processing personal data. You might want to ask your council to make inquiries into its background and whether it has the required public liability insurance to be doing enforcement work for them.

When you paid money on their website, that caused them to come round and get confrontational demanding more money.

It looks like Jacobs is messing you about and they will want their £310 fees as quickly as they think they can get away with.

Not even a company!!
How do they get away with this?
I have pleaded with the council to look at Jacobs behaviour and in each email response this is avoided. I had a half decent job etc and simply ended up unlucky and on hard times, it opened my eyes to how these people must treat people who are even worse off disgusting.
I was pretty sure that there were criteria were a bailiff company should follow some set of rules to deal with people's circumstances this has not been followed at all.
Are you saying that them charging me twice for a visit is legal? As far as I was aware this could only be done once £235.
I have paid in full my fine, and Jacobs original £75 charge, they are now chasing me for £235 of their charges for visit and threatening to charge me again if they visit again

Once the amount outstanding has been paid and you have evidence of the flow of money, the enforcement power ends.

The bailiff cannot take control of goods to recover the £235 enforcement stage fee because there is no longer an enforcement power.

The council is liable for everything if you are forced to make a money transfer under the pain of having your goods removed.

I paid the initial PCN charge and Jacobs original £75 to Jacobs does this make a difference?
Are you saying that there is nothing they can do to recover the £235 for visit?
They are saying this is outstanding to the council which we know is not true.

Only the PCN £203 goes to the council and the £75 goes in Simon Jacob's pocket.

Once that is paid before attending, no money is owed.

But the baliff have attended and charged me £235 for the privelage. Now they are persuing me for this £235 pretending it is outstanding to the council and threatening another illegal £235 for when they visit again. To me this is trying to obtain money by deception as they have already stated the £235 is owed to the collection agent. In essence they are charging me a fee for knocking to collect the fee for knocking!

They had also sent a baliff before I had paid the first charges in full, this is simply because I was not informed that the payment plan had been put back in place under instruction from the council. I believe Jacobs have done this as they had been told I had lodged a complaint about them. They say they informed me via post but I have received and responded to every other letter from them. I asked for proof they told me to take it up with royal mail.

A consultation is for complex enforcement matters. Your dispute is over £235 and you can give notice to stop harassing or pestering you. If the notice is breached then you can injunct.

Email. Say the amount Outstanding has been paid. If you continue to harass me for money I don't lawfully owe I will contact solicitor about applying for a restraining order under the Protection From Harassment Act for breach of paragraph 6(3) of schedule 12 of the Tribunals Courts and Enforcement Act 2007.

I just want to be clear that the amount owed ( charges for visit) isn't legally owed.

My original point with them is it was then that entered into an agreement then took my money then cancelled and demanded the lot

It's spiralled from there and I believe Jacobs have week and truly stitched me up, by not informing me that they had reinstated the payment plan that I obviously default. They didn't even ask what day of the month I could pay so s set up to fail from the off

If you get the amount Outstanding paid to the council then the enforcement ends.

That doesn't mean you are off the hook with the fees, but it does and the enforcement power.

Hi,
From what your saying it's looking like I'm legally obliged to actually pay this non company full of bullies the£235 they are demanding.
I was hoping to get a solicitor involved who specialises in these matters just on principal of fighting these crooks back, but from what you say it's looking like I'm going to have to just pay.
This system is so flawed in so many ways when crooks are legitimised.

Ideally highlight the flaws and malpractice in Jacobs, prove that this whole thing would have been avoidable of Jacobs has simply stuck to the original agreement which was already more than I had coming in and not put pressure on me to pay more that I didn't have forcing me to default on an agreement which is actually more of an ultimatum. Highlight and seek some sort of penalty against Jacobs for failing to follow codes of practice. And ultimately stop me having to pay more and even better if it stopped them treating others the same.

I don't think a solicitor can do that.

The bottom line is you don't have the money. That is more of a problem for Jacobs than a problem for you. They cant take what you don't have.

There is no obligation for bailiffs to accept periodical payments.

To accuse you of breaching an agreement when you havent only says about the character of Jacobs. More so if the false accusation was made to attract the benefit of a £235 enforcement stage fee.

You can make a formal complaint to the council and to solve the complaint, ask them to reinstate the agreement and withdraw the £235 enforcement charge.

If that fails and the council gives a final resolution, you can ask the Local Government Ombudsman to intervene.

I think I'm going to contact the ombudsman tomorrow.
I've asked the council to call off Jacobs especially as I've paid £185 in fine and charges already the debt is clear. I have explained the wrongful methods Jacobs employ and that I think it's terrible that a council not only condones but encourages and funds this behaviour.
The council beleive they have already intervened as good will as they reinstated the £20 pmth plan, failed to let me know this was done yet saw fit to let Jacobs know I had logged a formal complaint.
Each time I let the council know something Jacobs have done which breaches policies or guidelines it is completely ignored e.g. " contact Jacobs"
They have clearly ignored guidelines and rules more than once.
I had been made unemployed, not a penny coming in! Yet they still persue me, that is at least one instance which I automatically fall Into a volnerable person category.

Oh to add, in theory I did breach an agreement as I didn't know it was in place, my initial agreement was cancelled by Jacobs!

You cannot give personal data to jacobs because they are not registered under the data protection act.

It has to be either a named individual or 'legal persons' ie a company. An individual would be the norm for a sole trader or small company, the 'legal persons' would be used by large companies. 'Legal persons' doesn't need to name anyone specific.

In Jacob's case, there is no company. So it's a person. The only one on Companies House is Paula Jacob's.

They are currently intimidating me with a council tax debt I've broke the agreement twice once I didn't have the money the second time my bank card was froze they also had a problem with their recurring card payment system 1 month and tried to send the bailiffs out they are absolute scum I am a vulnerable single father I suffer with depression and anxiety they won't accept my agreement of £20 a month and want £210 in full in 6 days or they are sending bailiffs out I live alone with my 4 year old son I don't want them showing up but there's nothing I can do about it I spoke to the national debt advice and they told me to not let them in they can't force entry if they haven't been in your property before and just keep offering the £20 a month the debt help guy told me if I haven't got the money they can't get blood out of a stone but what happens if they arrive when I'm ready to take my son to school I'm going to have to open the door then they can get there foot in the door I'm snookered really
