CCJ enforcement advice

Post by freedom1979 »

Hi everyone,
I have a CCJ nearing the 6 year period (4 weeks). I haven't made any payments towards it. yesterday I received an email:

If payment of the sum of £x.xxx.xx is not received within 14 days from the date of this email we will issue Court proceedings against you for recovery of the outstanding monies without further reference to yourself. Interest is now being charged and any further costs incurred as a result of legal proceedings will be charged to your account.

I have been on long term sickness benefit and was hoping this would go away. I am on universal credit and have little by way of possessions.

I understand they can't issue an attachment of earnings to my UC because i am unemployed? If so, i am assuming they will send the bailiffs over. Would it be beneficial to just let them take my goods and once this is done, will that be the end of it?

As this relates to debt advice can I suggest you speak with one of the following:

https://www.citizensadvice.org.uk/about ... ontact-us/
https://www.stepchange.org/
https://www.nationaldebtline.org

As they are able to give debt advice.

Unfortunately we cannot as debt advice regulated by the FCA.

What you don't want to be doing is allowing a bailiff to enter your home or take you goods - in fact there is no need to deal with them at all!

Seek specialist advice from one of the above organisations ASAP! :-)

One thing to note is that if you do reply (to their demand) then the 6 year period starts again...... hence seek the specialist advice.

If the judgment debt is under £600 then its unlikely bailiffs will be instructed.

Thank's for the replies, appreciate it.

The debt is for almost £3,000. the initial debt i believe was about £800, so they have really added on their interest. I had a dealing with step change before, and I am quite certain any of these organisations will make me agree a payment plan or something, which I don't want to do. Hence contemplating just letting them seize my goods for it to be done with (if that's what happens). only items i really have that they could take is a tv costing £300 new and laptop £500 or so new, so more than happy to let these go if this goes away.

For now i think i will just ignore them if they come calling.

Thanks again

As an adviser at one of those charities I can assure you that at this stage setting up a repayment plan whilst would be an option wouldn't be at the forefront of my mind.

However, whatever you do - DO NOT DEAL with the bailiffs.

My suspicions are that as normal they are just trying to get you to respond to stop it getting statute barred. You can see the winning post in sight ;-)

Just let the 6 year mark get by they cannot get to you afterward. The 6 year statute is very expensive for institutional organisations and bailiff companies to break. I had a letter about a debt over 10 years old. I stated it was statute barred and they never wrote again. Just ignore it now. Don't reply.
